Terms of Use, Liability Waiver & Event Policy

1. Legally Binding Agreement

This is a legally enforceable contract. Host represents they have authority to bind all Guests. Acceptance occurs upon booking, payment, checkbox confirmation, or entry.

2. Assumption of Risk

Host acknowledges all inherent risks, including injury, illness, alcohol-related incidents, property damage, and third-party actions, and voluntarily assumes all risks, whether known or unknown.

3. Full Responsibility for Guests

Host accepts complete legal and financial responsibility for all Guests, including conduct, safety, supervision, and compliance with all laws.

4. Waiver & Release of Liability

To the fullest extent permitted under Washington law, Host releases and waives all claims against The Venue and its owners, employees, and affiliates for injury, death, or illness; property damage or loss; or any event-related incident — including claims arising from negligence, except where prohibited by law.

5. Indemnification

Host agrees to defend, indemnify, and hold harmless the Venue from any claims, lawsuits, damages, liabilities, or costs (including attorney fees) arising from the event, guest conduct, or breach of this Agreement, to the fullest extent allowed by Washington law.

6. Payment, Damages & Charge Authorization

Deposit is non-refundable. Full payment is required prior to the event. Host agrees to cover all damages, excessive cleaning, overtime, fines, or violations, and authorizes automatic charges to any payment method on file for such costs without further approval.

7. Noise & Operating Hours

Event must end by agreed time. Quiet hours apply per local city standards. Excessive noise or disturbances may result in immediate termination without refund. Host is responsible for any fines or complaints.

8. Alcohol Policy (Washington Law Compliance)

Host acknowledges strict compliance with RCW 66.44.270 (no furnishing alcohol to minors) and RCW 66.44.200 (intoxicated persons restrictions). Host assumes full liability for alcohol service, age verification, and preventing overconsumption. The Venue does not assume liability for alcohol-related incidents and reserves the right to stop service or terminate the event immediately.

9. Food & Allergy Disclaimer

Host acknowledges risks of food allergies and cross-contamination, and that no allergen-free environment is guaranteed. Under Washington product liability principles (RCW 7.72), Host assumes responsibility for informing Guests of risks and any allergic reactions or food-related claims.

10. Damages, Cleaning & Overtime

Host is liable for property damage, excessive cleaning, and overtime use. No nails, screws, tape, adhesives, or open flames are permitted. All décor must be removed at the end of the event. Vendors must be approved and may require $1,000,000 liability insurance listing The Venue as additional insured. Charges are assessed at The Venue's discretion.

11. Photo & Video Release

The Venue uses 24/7 audio/video monitoring. Recordings may be shared with authorities. Host grants the Venue unrestricted rights to capture and use photos/videos for marketing and promotional purposes without compensation. Host must inform all Guests of recording and media use.

12. Force Majeure

The Venue is not liable for delays or cancellations due to events beyond control, including natural disasters, power outages, or government orders. Remedy may include rescheduling or credit at The Venue's discretion.

13. Limitation of Liability

To the maximum extent permitted by law, The Venue's liability shall not exceed the total fees paid.

14. Governing Law & Venue

This Agreement is governed by Washington law. Any disputes shall be resolved in King or Snohomish County courts.

15. Severability

If any provision is unenforceable, the remainder remains valid.

16. Final Acceptance

By booking, checking the box, or entering the Venue, Host confirms full understanding, accepts all risks, and assumes full responsibility for all Guests.
